REPORT ON A STUDY OF PRACTICE AND PROCEDURE OF GRANTING AND REFUSING BAIL IN THE UNITED KINGDOM'S MAGISTRATES' COURTS AND RECOMMENDATIONS SET FORTH TO ENABLE THE COURTS TO RELEASE MORE PERSONS ON BAIL.
Abstract
THIS REVIEW REPRESENTS THE FIRST COMPREHENSIVE STUDY OF MAGISTRATES' COURTS BAIL PROCEDURES IN RECENT TIMES. A BRIEF HISTORY OF BAIL PROCEDURES IS PRESENTED AND THE PRESENT PROCEDURES FOR APPLICATION, EVALUATION, INSURING THE DEFENDANT'S APPEARANCE, PROVIDING BAIL INFORMATION TO THE COURTS, REMANDING AFTER CONVICTION, AND REVIEWING BAIL DECISIONS ARE ASSESSED. DIFFERENCES IN STATISTICS FOR MALE AND FEMALE OFFENDER GRANTED BAIL ARE EXPLAINED. RECOMMENDATIONS INCLUDE STANDARDIZING FORMS AND EVALUATION CRITERIA USED AND MODIFICATION OF THE CURRENT SURETY SYSTEM. APPENDIXES INCLUDE A LIST OF WORKING PARTY MEMBERS. A LIST OF EVIDENCE SOURCES, TABLES OF BAIL STATISTICS, SAMPLES OF FORMS USED BY THE NEW YORK RELEASE ON RECOGNIZANCES PROJECT AND THE DISTRICT OF COLUMBIA BAIL AGENCY, AND FORMS RECOMMENDED FOR USE IN THE MAGISTRATES' COURTS.
