The director of the Northeastern Regional Office of the National Center for State Courts (NCSC), at the request of the Criminal Procedural Rules Committee of the Pennsylvania Supreme Court, addressed general trends in State and Federal bail policy and made recommendations.
Abstract
The Committee was particularly concerned with post-conviction standards for bail, judges' discretion as to the type of bail a defendant may post, jail overcrowding, and lack of uniformity in setting bail. This report outlines 14 recommendations including the amendment or revision of Pennsylvania Criminal Rules 4001, 4003, 4006, 4010 b(2), 1508(a), 4004, Appellate Rule 1762(f), and the adoption of a provision such as that in Rule 46(b) of the Federal Rules of Criminal Procedure. It also makes more generalized rule revision recommendations that resources be concentrated on the earliest stages of criminal justice proceedings, and that the Committee work with the Pennsylvania Supreme Court, the Chief Justice, Administrative Office of Pennsylvania Courts, trial judges, district judges, district court administrators, members of the bar, and other institutions.
