The cost of litigation is a multifaceted concept with a given procedure or practice having differential consequences for the court, attorneys, litigants, and taxpayers.
Abstract
A central objective of the ABA Action Commission to Reduce Court Costs and Delay is to determine if a reduction in the time spent by attorneys -- key participants in the judicial resolution of disputes -- is followed by a reduction in costs to litigants. This article reports the results of test data from pilot programs designed to reduce specific aspects of attorney time. Initial results suggest that when time is saved, cost savings are subsequently realized although factors inhibit a one-to-one correspondence. (Publisher abstract)
