The domestic abuse arrest law in Wisconsin, enacted in 1987 and modified in the 1989 legislative session, recognizes the serious nature of domestic abuse, requires arrest for domestic abuse under certain circumstances, and requires law enforcement agencies to develop pro-arrest policies for other domestic abuse incidents.
Abstract
The law contains provisions on domestic abuse services, such as shelter, advocacy, and counseling, and provisions dealing with restraining orders, injunctions, and prosecution. The law identifies circumstances requiring arrest for domestic abuse and covers law enforcement policies, the conditional release of arrested persons, increased penalties for certain domestic abuse offenses, police officer immunity, prosecution policies, and police officer education and training in how to handle domestic abuse cases. Two appendixes list statutes relating to domestic abuse restraining orders, injunctions, increased penalties for certain domestic abuse offenses, and sexual assault.
