THIS MANUAL IS DESIGNED IN PART AS A FUNCTIONAL AID TO JUVENILE COURT JUDGES IN ACHIEVING A CERTAIN AMOUNT OF STANDARDIZATION WHILE ALLOWING THE JUDGE TO RETAIN AN OPTIMAL AMOUNT OF FLEXIBILITY.
Abstract
TO THIS END, THE AUTHOR SUGGESTS FACTORS AND STANDARDS TO GUIDE THE EXERCISE OF DISCRETION IN JUDICIAL DECISIONS-MAKING. ADDITIONALLY, THIS MANUAL ATTEMPTS TO EXPLAIN IN NARRATIVE FASHION THE ARKANSAS AND FEDERAL LAW RESPECTING JUVENILES, AS WELL AS THE RELEVANT FEDERAL AND STATE COURT DECISIONS GUARANTEEING ACCUSED JUVENILE OFFENDERS PROCEDURAL DUE PROCESS AND OTHER RIGHTS. WHERE THE LAW IS NOT CLEAR, THE WRITER HAS ATTEMPTED TO SPECULATE UPON RATHER THAN PROPHESY POSSIBLE FUTURE DECISIONS. A SET OF UNIFORM RULES OF JUVENILE COURT PROCEDURE (IN THE PROCESS OF BEING REVIEWED BY THE ARKANSAS SUPREME COURT FOR MANDATORY USE IN ALL STATE JUVENILE COURTS) HAS BEEN INCLUDED AND EXPLAINED AS A PART OF THE MANUAL.
