This document presents U.S. Supreme Court amendments to the Federal Rules of Criminal Procedure, effective as of December 1, 1991; the rules involved are 16(a), 32(c), 32.1(a), 35(b) and (c), 46(h), 54(a), and 58(b) and (d).
Abstract
The amendment to 16(a)(1)(A) would slightly expand the duty of the Federal Government to disclose a defendant's oral statements. The amendment to Rule 35(b) would permit the Federal Government to move the sentencing court to reduce the defendant's sentence for substantial assistance more than one year after the imposition of sentence under certain circumstances, and the amendment to Rule 35(c) would permit the court to correct a technical error in a sentence within 7 days of its imposition. The amendments to Rules 32(c)(2)(A), 32.1(a)(1), 46(h), 54(a), 58(b)(2)(A), and 58(d)(3) would correct technical errors. It summarizes the nature of the proposed amendments to the Federal Rules of Criminal Procedure.
