A BRIEF REVIEW OF THE EVOLUTION OF CONDITIONAL SENTENCING IN BELGIUM SINCE 1888 IS FOLLOWED BY A DISCUSSION OF THE PROVISIONS OF 1964 LEGISLATION COVERING THE USE OF DEFERRED AND SUSPENDED SENTENCES AND PROBATION.
Abstract
UNDER THIS LEGISLATION, JUDGES HAVE THE OPTION OF SIMPLY DEFERRING SENTENCING, DEFERRING SENTENCING WHILE REQUIRING THE DEFENDANT TO FULFILL CERTAIN OBLIGATIONS (SIMILAR TO PROBATION), HANDING DOWN A SUSPENDED SENTENCE, OR SUSPENDING A SENTENCE SUBJECT TO THE FULFILLMENT OF CERTAIN CONDITIONS. OTHER SENTENCING ALTERNATIVES AVAILABLE TO THE JUDGE WHICH CAN BE USED AS PARTIAL SUBSTITUTES FOR PRISON OR JAIL SENTENCES INCLUDE WEEKEND DETENTION, SEMI-DETENTION IN A HALFWAY HOUSE OR OTHER COMMUNITY TREATMENT CENTER, WORK AND STUDY RELEASE, AND SPECIAL FURLOUGHS. THE CONDITIONS UNDER WHICH EACH OF THESE MEASURES CAN BE APPLIED AND THEIR PERCEIVED REHABILITATIVE EFFECT ARE OUTLINED. STATISTICAL DATA IS ALSO PRESENTED ON THE APPLICATION OF PROBATION AND OTHER ALTERNATIVES TO IMPRISONMENT BETWEEN 1965 AND 1968, THE TYPES OF OFFENSES PUNISHABLE BY SHORT-TERM IMPRISONMENT, AND THE AGES OF OFFENDERS SENTENCED TO SHORT-TERM IMPRISONMENT. --IN FRENCH...ELW
