THE VALUE OF EFFECTIVENESS OF SOLVING PROBLEMS OF CORRECTIONAL INSTITUTIONS THROUGH LITIGATION HAS BEEN DEBATED FROM MANY PERSPECTIVES. THE REPORT PRESENTS RESULTS OF SUCH LITIGATION.
Abstract
EACH STUDY CONCERNS THE JUDICIAL DECREE IMPLEMENTATION AT PARTICULAR FACILITIES (BALTIMORE CITY JAIL, MD.; ORLEANS PARISH PRISON AND JEFFERSON PARISH PRISON, NEW ORLEANS, LA.; AND THE ARKANSAS PENITENTIARIES). HOW THE JUDICIAL WILL WAS ACCOMMODATED IN EACH INSTANCE IS EXPLAINED. EXTENSIVE DATA REVEAL THE FOLLOWING: TO WHICH EXTENT THE COMPLIANCE WAS ACHIEVED; FACTORS INFLUENCING COMPLIANCE AND NONCOMPLIANCE; AND THE DECREES' IMPACT ON THE CORRECTIONAL INSTITUTIONS AND THE PEOPLE CONNECTED WITH THEM. PRINCIPAL ISSUES LITIGATED INCLUDED DISCIPLINE, MEDICAL CARE, GENERAL CONDITIONS, OVERCROWDING, AND SEGREGATION. THE PROJECT ALSO HELPS INTERESTED PERSONS AND AGENCIES ESTIMATE THE VALUE OF HUMAN AND FINANCIAL RESOURCE INVESTMENTS IN CORRECTIONAL LAW. THE METHODOLOGY OF THIS PROJECT IS EXPLAINED FOR THE BENEFIT OF FUTURE RESEARCHERS. FOOTNOTES AND A LIST OF PERSONS INTERVIEWED FOR THE STUDY ARE PROVIDED.
