THIS REPORT WAS PREPARED BY THE UTAH ADVISORY COMMITTEE AND FOCUSES ON CIVIL RIGHTS PROBLEMS AND AFFIRMATIVE ACTION IN CRIMINAL JUSTICE AGENCIES IN THE CITY AND COUNTY OF SALT LAKE.
Abstract
DURING THE LATTER PART OF 1976, THE COMMITTEE INVITED MEMBERS OF THE SALT LAKE COMMUNITY TO PRESENT IDEAS AND CONCERNS ABOUT PROBLEMS INVOLVING MINORITIES AND WOMEN. THIS EFFORT WAS PART OF THE COMMITTEE'S RESPONSIBILITY TO ADVISE THE U.S. COMMISSION ON CIVIL RIGHTS OF AFFIRMATIVE ACTION PROBLEMS IN THE STATE. IN JUNE 1977, AN EMPLOYMENT QUESTIONNAIRE WAS ADMINISTERED TO PERSONNEL IN FIVE CRIMINAL JUSTICE AGENCIES IN THE CITY AND COUNTY OF SALT LAKE. ALTHOUGH EQUAL EMPLOYMENT OPPORTUNITY (EEO) DIRECTORS HAD BEEN APPOINTED AND AFFIRMATIVE ACTION PLANS HAD BEEN DRAFTED, MINORITIES SELDOM APPEARED ON MERIT LISTS, FEW TOOK EMPLOYMENT TESTS, AND MANY OF THOSE TESTED DID NOT PASS. ELEMENTS OF THE AFFIRMATIVE ACTION PLAN FOR SALT LAKE CITY HAVING AN ADVERSE IMPACT ON MINORITIES AND WOMEN WERE THE LACK OF GOALS AND TIMETABLES FOR ORGANIZATIONAL UNITS AND JOB CLASSES, NO ACTION PROGRAM OR ANY PLAN DIRECTED TOWARD THE ELIMINATION OF PROBLEMS ENCOUNTERED IN ACHIEVING GOALS AND OBJECTIVES FOR JOB PLACEMENT AND UPWARD MOBILITY OF MINORITIES AND WOMEN, NO REVIEW OF PERSONNEL POLICIES AND PRACTICES IN COMPLIANCE WITH SEX DISCRIMINATION GUIDELINES, LACK OF CONSIDERATION GIVEN TO RECRUITABLE MINORITIES AND WOMEN NOT IN THE WORK FORCE, AND SEXIST LANGUAGE. THE FIVE CRIMINAL JUSTICE AGENCIES HAD NO OUTREACH AND RECRUITMENT PROGRAMS IN OPERATION, NO STRONG RECRUITMENT PROGRAMS THROUGH PUBLIC AGENCIES AND EMPLOYMENT OFFICES, NO CONSISTENCY IN EXAMINATION PROCESSES, AND NO SYSTEMATIC WAY OF CONDUCTING SELECTION AND APPOINTMENT PROCESSES. THE CONCEPT OF EQUAL EMPLOYMENT OPPORTUNITY, EVIDENCE OF DISCRIMINATION IN THE POLICE DEPARTMENT AND THE COURTS IN SALT LAKE, AND GOALS AND CHARACTERISTICS OF AFFIRMATIVE ACTION PLANS ARE DISCUSSED. APPENDIXES CONTAIN LETTERS ON AFFIRMATIVE ACTION FROM THE SALT LAKE COUNTY SHERIFF AND THE COUNTY ATTORNEY. TABULAR DATA ON EEO IN THE CITY AND COUNTY FOR 1975-1978 ARE PROVIDED. (DEP)
