The problem of violence between spouses and lovers has come, in less than a decade, to command substantial attention in a number of industrialized countries. This paper traces the law's response to that problem, focusing primarily on the Anglo-American legal tradition and on recent developments in the United States.
Abstract
Brief looks at the French and Swedish experiences underscore both common problems and variations in approach resulting from differences in legal systems and emphases. Central questions about the appropriate role of the legal order, and in particular the civil/criminal dichotomy, highlighted by the historical survey are considered in a concluding section. Particular attention is given throughout to the relative powerlessness of women and the problem's deep roots in sex role socialization. (Author abstract)
