This manual describes the value and availability of domestic violence orders of protection in Illinois and suggests practical tools for lawyers to use when representing domestic violence victims.
Abstract
The first chapter provides guidelines for attorneys in interviewing and counseling domestic-violence clients. Topics addressed include the goals and methods of the interview and counseling, as well as how to overcome barriers to effective representation of such clients. A chapter on the Illinois Domestic Violence Act outlines its purposes and effects as well as its legislative history. Among the purposes of the act are to provide tools for police officers to deliver immediate, effective assistance and protection for victims of domestic violence and to expand the civil and criminal remedies for such victims. It creates a new domestic violence order of protection. This is a written judicial order that directs an abusive family or household member to refrain from specified conduct and to meet specified responsibilities. A chapter details the components of and methods of implementing and enforcing a domestic violence order of protection. The final chapter presents guidelines for attorneys in obtaining orders of protection. It includes guidelines for judicial decisionmaking, prerequisites, relevant factors, and 10 order-of-protection remedies.
