This document discusses the legal and policy issues associated with the release of criminal history information to private employers for use in connection with employment decisionmaking.
Abstract

It describes the relevant constitutional, statutory, and caselaw holdings and discusses the relationship of the legal framework to differing policy positions. Arguments for and against employment use of criminal history data are discussed, and particular attention is directed to the legal and policy distinctions between differing categories of criminal history information. The document is the second in the series of materials which analyzes criminal justice information policy issues of current interest. (Author abstract modified)
