This book presents briefs of leading correctional court cases in the areas of prison law, probation, parole, the death penalty, juvenile justice, and sentencing.
Abstract
Each brief provides information on the facts of the case, the issue in the case, the court decision, the rationale for the court decision, case significance, and a list of related cases. Cases in prison law address 26 topics, including confinement conditions, modification of a consent decree, court access, disciplinary hearings, discrimination, due process, use of force, mail, medical care, inmate safety, freedom of religion, searches and seizures, and visitation. Nine cases pertain to probation. Among the issues addressed are the right of a defendant to have an attorney during probation revocation that is followed by sentencing, due process rights during revocation hearings, the constitutionality of revoking probation for inability to pay a fine or restitution, and the constitutionality of the search of a probationer's home based on reasonable grounds (lower than probable cause). Seven cases deal with parole issues; 14 cases pertain to the death penalty; 12 cases concern juvenile justice issues; and 9 cases involve sentencing. Table of cases
