CRITICAL EXAMINATION OF THE PROBATION SYSTEM IN BELGIUM WHICH FOUND THAT THE OPTIONAL PRELIMINARY INVESTIGATION OF THE SOCIAL BACKGROUND OF OFFENDERS AS A BASIS FOR SENTENCING WAS USED IN ONLY 10 PER CENT OF THE CASES.
Abstract
THE STUDY ALSO FOUND THAT INSUFFICIENT AND INAPPROPRIATE INFORMATION WAS USED AS A BASIS FOR DETERMINING INDIVIDUALIZED SANCTIONS, AND THAT OFFENDERS WERE NOT PROPERLY INFORMED OF THE NATURE OF ALTERNATIVE SANCTIONS PRIOR TO SENTENCING. THE PAPER PROPOSES THE ESTABLISHMENT OF REGIONAL CENTERS WITH MULTIDISCIPLINARY TEAMS OF SPECIALISTS TO DEVISE SOPHISTICATED DOSSIERS ON INDIVIDUAL OFFENDERS TO BE USED AS A BASIS FOR DETERMINING INDIVIDUALIZED TREATMENT PROGRAMS. --IN FRENCH
