DISCUSSION OF FUNCTIONALIST AND MARXIST APPROACHES TO CRIMINALITY AND PENAL LAW.
Abstract
TOPICS DISCUSSED ARE CRIME AND SOCIETY, FUNCTIONS OF CRIME AND CRIMINAL POLICY, THE STATE AND THE PENAL SYSTEM, THE GOALS OF CRIMINAL POLICY, AND POLITICAL AND IDEOLOGICAL TASKS OF THE PENAL SYSTEM. CONCLUSIONS INCLUDE THAT ONLY IN EXCEPTIONAL CASES IS CRIME OF BENEFIT TO A GIVEN HISTORICAL SOCIETY AND THAT TRADITIONAL PENAL LAW CAN EXERCISE IMMEDIATE REPRESSIVE FUNCTIONS IN SITUATIONS OF SOCIAL CONFLICT.
