A DISCUSSION OF THE PROBLEMS AND A SOLUTION PROCEDURE IN IMPLEMENTING THE SUPREME COURT BARKER V. WINGO DECISION ON THE RIGHT TO A SPEEDY TRIAL.
Abstract
IT IS CONSIDERED THAT THE SUPREME COURT'S RENDERING OF BROAD GUIDELINES FOR A SPEEDY TRIAL CREATES PROBLEMS OF IMPLEMENTATION. THE SUGGESTION IS MADE THAT STATES SHOULD REMEDY THE LACK OF SPECIFICITY BY ENACTING STATUTORY STANDARDS FOR A SPEEDY TRIAL. THE AMERICAN BAR ASSOCIATION'S STANDARDS WHICH SET FORTH A CONCRETE PROCEDURE TO DETERMINE WHAT IS A SPEEDY TRIAL ARE SUGGESTED AS AN EFFECTIVE MODEL FOR STATUTE OR COURT RULE.
