A PAPER CONSIDERING THE LEGISLATION TO INVOLVE PSYCHIATRY AT VARIOUS STAGES OF THE CRIMINAL-LEGAL PROCESS IN CANADA, THE PROTECTION AFFORDED SOCIETY AND THE ACCUSED, AND THE POSSIBLE ABUSES AT EACH STAGE.
Abstract
THE PREARREST, PRETRIAL, TRIAL, AND POST-CONVICTION (PRE-SENTENCE) STAGES ARE CONSIDERED. THE CHALKE REPORT, WHICH FOUND THE MINIMUM STANDARD OF PSYCHO-MEDICAL SERVICES ABSENT OR ALMOST ABSENT FROM PENAL INSTITUTIONS ACROSS CANADA, IS DISCUSSED. THE AUTHOR SUPPORTS THE REPORTS SUGGESTION THAT SPECIAL HOSPITALS BE ESTABLISHED TO HANDLE BOTH CORRECTIONAL INMATES AND NON-INMATES WHO ARE IN NEED OF A CERTAIN DEGREE OF SECURITY AS WELL AS RESIDENTIAL PSYCHIATRIC TREATMENT. CONCERN IS EXPRESSED. HOWEVER, OVER THE LACK OF PROVISIONS FOR PROTECTION OF THE PATIENTS CIVIL RIGHTS. --SUMMARY IN FRENCH
