PROPOSES A CENTRALIZED ADMINISTRATION OF ALL PRETRIAL STATUS ALTERNATIVES.
Abstract
A UNIFIED CENTRALIZED AGENCY IS RECOMMENDED IN ORDER THAT PRETRIAL DECISIONS BE BASED ON MORE COMPLETE DEFENDANT INFORMATION AND MORE CAREFUL CONSIDERATION COULD BE GIVEN TO ALTERNATIVES FROM WHICH TO CHOOSE. IT IS ALSO CONSIDERED THAT FUNDING WOULD REFLECT A MORE ACCURATE ASSESSMENT OF THE NEEDS OF ALL THE VARIOUS ELEMENTS OF THE PRETRIAL PROCESS. IT IS MAINTAINED THAT THE ESTABLISHMENT OF SUCH AN AGENCY WOULD LEAD TO THE RELEASE OF MORE PRETRIAL DEFENDANTS AND THE IMPOSITION OF MORE APPROPRIATE RESTRICTIONS, WHILE THE COST AND FAILURE TO APPEAR RATES ARE EXPECTED TO REMAIN WITHIN ACCEPTABLE RANGES. THE PROS AND CONS OF THE VARIOUS ALTERNATIVES FOR WHERE TO PLACE THE AGENCY IN THE CRIMINAL JUSTICE SYSTEM ARE DISCUSSED.
