STATE JUVENILE DETENTION SYSTEM IS EXAMINED BY CONTRASTING PROCEDURES IN URBAN MARICOPA COUNTY AND RURAL PINAL COUNTY.
Abstract
THE EFFECTS OF 'CONTAGION' RESULTING FROM EXPOSING JUVENILES WITH A VARIETY OF PROBLEMS TO EACH OTHER ARE DISCUSSED. THE LEGAL IMPLICATIONS OF PRETRIAL DETENTION OF JUVENILES, INCLUDING THE BROAD AND VAGUE NATURE OF DETENTION STATUTES, THE LACK OF DUE PROCESS IN DETENTION PROCEEDINGS, AND THE LACK OF A DETERMINATION OF PROBABLE CAUSE, ARE ALSO EXAMINED. ALTERNATIVE PROCEDURES SUGGESTED FOR ARIZONA'S SYSTEM OF JUVENILE DETENTION INCLUDE BAIL FOR JUVENILES AND PROCEDURAL DUE PROCESS IN DETENTION HEARINGS.
