THIS ARTICLE EXPLORES THE MANNER IN WHICH COURTS HAVE DEVELOPED AND DEALT WITH BALANCING THE PROBATIVE WORTH AND UNFAIR PREJUDICE OF PHOTOGRAPHS USED AS EVIDENCE.
Abstract
PHOTOGRAPHS ARE INCREASINGLY USED AS EVIDENCE IN BOTH CIVIL AND CRIMINAL CASES. THIS ARTICLE EMPHASIZES THE PROPER WEIGHING OF THE UNFAIR PREJUDICIAL PHOTOGRAPHS IN CRIMINAL CASES AGAINST THEIR PROBATIVE VALUE, AND BRIEFLY LOOKS AT CIVIL CASES FOR COMPARISON PURPOSES. THE COURT DECISIONS DISCUSSED RELATE PRIMARILY TO THE LAW IN TEXAS. THE AUTHOR CONCLUDES THAT THE PRESENT LAW IN TEXAS FOR THE ADMISSION OF INFLAMMATORY PHOTOGRAPHS IS TOO BROAD....MSP
