DISCUSSION OF SUGGESTED REFORMS FOR POLICE AND COURT PROCEDURES REGARDING THE DETENTION OF SUSPECTS DURING CRIMINAL INVESTIGATIONS IN BELGIUM AND A COMPARISON WITH PROCEDURES USED IN OTHER WESTERN EUROPEAN COUNTRIES.
Abstract
THE BELGIAN SYSTEM OF INVESTIGATORY DETENTION HAS NOT UNDERGONE BASIC CHANGES SINCE ITS ADOPTION IN 1874. DISCUSSED ARE SAFEGUARDS FOR PROTECTING THE RIGHTS OF THE SUSPECT AS WELL AS THE ISSUES OF HOW LONG A SUSPECT MAY BE HELD, HOW SERIOUS THE OFFENSE MUST BE TO PERMIT DETENTION, AND WHETHER INNOCENT DETAINEES SHOULD RECEIVE COMPENSATION. COMPARED ARE PROCEDURES IN FRANCE, WEST GERMANY, THE NETHERLANDS, AND ITALY. --IN FRENCH
