This program book contains materials regarding legal rights and institutional reform litigation and includes relevant court cases and consent decrees.
Abstract
Issues to be addressed at the meeting are given, such as framing and enforcing the decree, the interplay between the judicial and political processes, bringing the implementation phase to closure, and modification of decrees to reflect the current scope of legal rights. Pertinent authorities are cited. A paper entitled, 'Legal Rights and Institutional Reform Litigation: Can the Judiciary Produce Results?', authored by Steven Horowitz is included. The paper discusses the involvement of the judiciary in the resolution of public policy disputes and judicial compliance mechanisms. The case of Kalima Jenkins, et al., v. State of Missouri, et al., and School District of Kansas City, Missouri, et al., is presented. Several consent decrees are also included.
