THE COMPENSATION AND RESTITUTION SCHEME PROPOSED HEREIN IS DISTINGUISHED BY ITS INCLUSION OF NON-VIOLENT CRIME VICTIMS AS BEING ELIGIBLE FOR REWARDS AND THE EXCLUSION OF CORPORATIONS AS VICTIMS.
Abstract
THE SCHEMES IN GREAT BRITAIN AND NEW ZEALAND ARE BRIEFLY EXAMINED, AND IT IS OBSERVED THAT THE NUMBER OF CLAIMS AND THE MONETARY COST OF RUNNING THOSE PROGRAMS WAS UNEXPECTEDLY LOW. A TEN POINT PROPOSAL IS SET FORTH THAT PROVIDES FOR PAYMENTS ON PRIMA FACIE EVIDENCE THAT A CRIME HAS BEEN COMMITTED WHETHER OR NOT THE OFFENDER IS CAUGHT AS WELL AS THE RIGHT OF THE COMPENSATION BOARD TO PURSUE CIVIL ACTIONS AGAINST OFFENDERS TO RECOVER COMPENSATION PAYMENTS.
