American Bar Association (ABA) recommendations pertaining to the criminal justice system's dealing with AIDS in various contexts focuses on criminal law sanctions, criminal procedure and courtroom procedure, and correctional facilities.
Abstract
Recommendations concerning criminal sanctions address the application of traditional criminal laws, sexually-transmitted-disease statutes, HIV (human immunodeficiency virus)-specific statutes, State statutes, and sanctions outside the criminal law. Among the topics considered regarding criminal procedure and courtroom procedure are education, victims, HIV defendant's access to counsel, the routine processing of HIV cases, access to the courtroom and courtroom procedures, medical information and confidentiality, HIV status and sentencing, and HIV status and bail. Regarding AIDS in correctional facilities, ABA recommendations address training and education, medical care and counseling services, segregation and HIV-antibody testing, confidentiality, and parole and other community release. 36 notes, appended additional ABA policy concerning AIDS.
