Certifications of Compliance with 8 U.S.C. § 1373

Certification from applicant to FY 2017 Byrne JAG Program. States and units of local government that apply for awards under the FY 2017 Edward Byrne Justice Assistance Grant ("Byrne JAG") Program will be required to submit a specific certification from the chief legal officer of the applicant government (e.g., the Attorney General of the State) regarding the applicant’s compliance with 8 U.S.C. § 1373. (This requirement does not encompass Indian tribes.) The required certification must be submitted using the following form:

Certifications from proposed subrecipients under FY 2017 Byrne JAG Program. A State or unit of local government that receives an award under the FY 2017 Byrne JAG Program will be required (by award condition) to obtain a properly-executed certification regarding compliance with 8 U.S.C. § 1373 from any proposed subrecipient that is a unit of local government or a "public" institution of higher education (i.e., one that is owned, controlled, or directly funded by a State or unit of local government). The specific certification required from a unit of local government will differ from the specific certification required from a "public" institution of higher education. (The requirement for a subrecipient certification regarding 8 U.S.C. § 1373 will not encompass subawards to Indian tribes).
The forms for the required specific subrecipient certifications regarding compliance with 8 U.S.C. § 1373 will be posted on this webpage and available for download at or about the time OJP makes awards under the FY 2017 Byrne JAG Program.
Certifications under other FY 2017 OJP programs. OJP also may apply similar certification requirements to State and local governments under certain other FY 2017 grant or related reimbursement programs. OJP will update this page as appropriate to identify any additional FY 2017 OJP programs that will require a certification regarding compliance with 8 U.S.C. § 1373, and will post the forms for such certifications on this webpage.
